YonetimTR Terms of Use
This text sets out the terms of use for the YonetimTR service provided by Artech Yazılım Otomasyon Bilişim Sanayi ve Ticaret Limited Şirketi. By starting to use the service, you agree to these terms.
In short: YonetimTR is a subscription service. You are responsible for your own content and your obligations to your customers; we are responsible for the service running properly.
1. Scope of the Service
YönetimTR is a cloud-based software platform that offers businesses a corporate website, content management, multilingual publishing, QR menu, digital ordering and request management, multi-channel messaging (WhatsApp, Instagram, web chat), and AI-powered assistant services.
The service is subscription-based and includes different features depending on the selected package. Package contents and prices are valid as published.
2. Account and User Responsibility
- The user is responsible for keeping account information and passwords confidential.
- All actions taken through the account are deemed to have been made on behalf of the account-owning business.
- The business is responsible for the content it enters into the panel, the information it publishes, and its obligations to its own customers.
- If unauthorized access is detected, it must be reported immediately.
3. Unacceptable Use
The platform may not be used for the following purposes:
- Publishing illegal, misleading, or third-party rights-infringing content,
- Sending unauthorized bulk messages or unsolicited communication (spam),
- Violating the WhatsApp Business Platform and Meta platform policies,
- Attempting to threaten system security or performing reverse engineering,
- Reselling or transferring the service to third parties (without written permission).
4. Messaging Channels
The infrastructure for WhatsApp, Instagram, and Messenger is provided by Meta Platforms, Inc. Meta’s own terms also apply when using these channels.
The business is responsible for complying with the relevant laws and platform rules when communicating with its own customers. Artech cannot be held responsible for restrictions imposed by Meta due to policy violations.
5. AI Responses
Assistant responses are generated automatically and may contain errors. The business is responsible for final verification of binding information such as prices, stock, reservations, and campaigns.
The business defines the information and content the assistant will use; the business is responsible for the accuracy of that content.
6. Fees and Payment
- Subscription fees are collected upfront according to the selected period.
- If the monthly AI message allowance included in the package is exceeded, additional usage is charged separately.
- Price changes are notified before they take effect and do not apply to the current period.
- Payment transactions are processed through licensed payment providers; card information is not stored on the platform.
7. Suspension and Termination of the Service
The service may be suspended or terminated in case of non-payment, breach of these terms, or use that violates Meta platform policies.
The business may end its subscription at any time. Termination takes effect at the end of the paid period.
8. Data and Privacy
The principles regarding the processing of personal data are explained in the Privacy Policy and KVKK Disclosure Text. Requests for data deletion are also made according to the procedure stated in that text.
9. Service Continuity
Reasonable efforts are made to ensure uninterrupted service. Scheduled maintenance work is announced in advance.
Artech cannot be held responsible for outages caused by Meta, payment providers, AI providers, or hosting providers.
10. Limitation of Liability
The service is provided “as is.” No liability is accepted for indirect damages, lost profits, or claims arising from data loss.
In any case, total liability is limited to the subscription fee for the last three months before the event giving rise to the claim.
11. Intellectual Property
All rights to the platform’s software, design, and all components belong to Artech. Content and data uploaded to the platform by the business belong to the business.
12. Changes
These terms may be updated from time to time. The current version becomes effective on the date it is published; material changes will be notified to users.
13. Governing Law and Jurisdiction
The laws of the Republic of Türkiye apply to these terms. In disputes, the courts and enforcement offices of İzmir have jurisdiction.
